                                                                            O R D E R

                                                The case of the Complainant in short is that after his retirement from Forest Department, his pension was sanctioned vide P.P.O No. OR/BBS/00045447 by the Opp. Party with effect from 16-08-2012 but the sum of Rs. 3,376/- was credited to his account bearing No.11692659655 of S.B I, Charichhak branch.  His monthly pension was Rs. 844/- per month. So, he is entitled to get Rs. 32,916/- for the period from 01-09-2012 to November 2015. He had received Rs. 3376/- and rest amount of Rs. 29,540/- has not been deposited in his account. Due to nonpayment of the above amount he is facing mental agony and financial loss which amounts to deficiency in service on the part of the O.Ps. Hence, this complaint is filed by him to get Rs. 29.540/- with 18 % interest per annum along with compensation of Rs. 10,000/- towards mental agony and financial loss and Rs. 3000/- as cost of litigation.

                                                The case of the O.P as per his version is that on verification of record it is found that the Complainant submitted the F/10-D swing Non CBS Bank Account No. 01190005049 for sanction of pension. On receipt of the claim application the pension of the Complainant was settled and the monthly pension was fixed for Rs. 844/- per month. The C.B.S account No. 11692659655 of the Complainant was received only during November 2015 from the bank authority. So, monthly pension has been enhanced to 850/- from 01-09-2014 and the sum has been paid up to March 2017 .

Regarding non receipt of the pension from the period 09/2012 to 07/2015, it is submitted that the pensioner neither submitted his copy of the pass book showing his CBS account number nor submitted any complaint regarding non receipt of the monthly pension for the said period. However he has taken up the matter with bank authority to confirm the payment position of the pension for the said period. On perusal of the clarification of the Bank, the office of the O.P has taken immediate action for release of the pension amounting Rs. 29,540/- through their application software and the same will be credited to SBS account number of the Complainant . Hence, there is no deficiency in service on the part of the O.P.

                                                During course of hearing we have heard the Complainant and the learned counsel appearing on behalf of the O.P. We have perused the complaint petition, the written version of the O.P and the documents filed by both parties in support of their case. It is seen that the O.P has filed a petition through his advocate that the amount to the tune of Rs.29.540/- has already been released by the O.P vide Scroll No. OR/BBS/04-2017/C/000/EPS-M/20dated, 25-04-2017 and vide Cheque No.046809 dated 25-04-2017. The Complainant has no objection. Hence, in the above circumstances there is no deficiency in service on the part of the O.Ps.

                                                Accordingly the complaint filed by the Complainant is closed and disposed of. Supply free copies of this order to both the parties.
