Opposite Party <br /> <br /> (Ex-parte)<br /> <br /> ORDERS<br /> <br /> This is a complaint under section 12 of the Consumer Protection Act, 1986 praying for a direction against the opposite party to pay Rs.21,585/- with costs and interest etc., <br /> <br /> <br /> <br /> <br /> CC No.301/2007<br /> 2. The grievance made by the complainant may be stated as follows: The complainant is proprietor of Super Engineering Works, Kolar. It is a registered electrical contractor executing the electrical work in PWD, Municipality and Panchayat Raj Engineering Division. The opposite party is in-charge of supplying water to the villagers, under Rural Water Supply Scheme. The opposite party entrusted to the complainant, the works of carrying out the repairs to the pump-sets, motors and panel boards installed in villages situated in Bangarpet Taluk for the year 1996-97. It is alleged that in respect of the work carried out by the complainant a sum of Rs.21,585/- is due from opposite party and he failed to clear the arrears inspite of repeated demands. <br /> <br /> The present complainant had filed CC 55/2005 against Chief Secretary, Zilla Panchayat, Kolar and the Excutive Engineer, Technical Division, Zilla Panchayat, Kolar for similar claim in respect of work turned out by him in Kolar District and in the said complaint the present claim for Rs.21,430/- was also included but the said claim for Rs.21,430/- was rejected on the ground that the present opposite party was not a party in that case and the opposite parties in that case had contended that they were not liable to pay the said amount. However the remaining claim was allowed in that case after contest. <br /> <br /> 3. The opposite party did not appear inspite of service of notice before this Forum. The complainant filed certified copy of order in CC 55/2005. On perusal of the records and the order in CC 55/2005 we think the claim for Rs.21,430/- may be accepted. It appears that the order in CC 55/2005 dated 27.09.2007 is not challenged by the opposite parties in that case. <br /> <br /> <br /> CC No.301/2007<br /> 4. Hence we pass the following:<br /> <br /> O R D E R <br /> The complaint is allowed with costs of Rs.1,000/-. The opposite party shall pay Rs.21,430/- (Twenty One Thousand Four Hundred Thirty only) to complainant with interest at 6% per annum from the date of complaint till the date of payment within two months from the date of this order.
