ORDER

By SRI.K. VIJAYAKUMARAN ACHARY, PRESIDENT. This complaint is filed by the complainant against the opp.party praying to quash the addition bill towards water charges. The averments in the complaint are that: The complainant is a consumer No.PRV/539. In continuation of his father he is remitting water charges as per the bills issued by the opp.party regularly. On 6.12.2005 the first opp.party issued a bill for Rs.2831/- with a direction to remit the amount within 7 days failing which the connection will be disconnected. On 8.12.2005 the complainant informed the opp.party by an advocate notice that he is not liable to pay the above sum and that he is bound to pay the arrears due to the last 6 months. Thereafter, in the month of June 2006 without giving any notice the opp.party disconnected the water connection of the complainant. When the complainant approach the opp.party they agreed to provide reconnection on paying the above sum by 8 instalments and accordingly the complainant approached the opp.party on 30.6.2006 for paying of the first installment. There upon the opp.parties issued another bill for Rs. 7,141/- in which the period of claim is not mentioned. The complainant or his family have not consumed so much water. In the month of December 2005 they have issued the bill for Rs.2831/- and in the month of June 2006 the opp.parties have issued another bill for Rs.7141/-. Moreover without giving notice this connection was also disconnected from which it is obvious that the intention of the opp.party is to harass the complainant. Hence the complaint. The opp.party were duly served and they entered appearance but they did not file any version and subsequently they remained and hence they were set exparte. The complainant thereafter filed affidavit and Ext.P1 to P3 were marked. Ext.P1 is the bill dated 6.12.2005 for Rs.2831/-, It is not specified in the above bill the period for which the bill relates but vaguely stated arrears and penal interest. Ext.P3 is another bill for Rs.7141/-. In Ext.p3 it is stated that the bill is for the period from 6.12.2005 to 5/2006. The previous meter reading and the reading as on the date of bill etc, are left blank in the bill. Therefore it cannot be ascertained as to how much water was consumed by the complainant per month or during the period . From the averments in the complaint it is seen that the connection is for domestic purpose and not for any commercial purpose and as argued by the complainant such an exorbitant consumption of water during the period is quite improbable. It is also to be noted that the water meter is not faulty.Ext.P1 and P3 clearly shows that bills were issued without showing the details which the opp.parties ought have done which will amount to gross negligence and deficiency in service on the part of the opp.parties. Therefore, we are inclined to quash Ext.P1 and P3 bills In the result the complaint is allowed, quashing the Ext.P1 and P3 bills and directing the Opp.parties to reconnect the water supply to the complainant and to pay a sum of Rs.3,000/- towards compensation and costs to the complainant. The opp.parties may issue proper bill as per law showing all details. The order is to be complied with within one month from the date of receipt of this order.
