ORDER

Complainant/petitioner applied for water connection on 7.6.1996 and deposited a sum of Rs.601/- for the same.  The water connection was not given as under Rule 13 of the Rajasthan Water Distribution Rules, 1967 it was the responsibility of the petitioner to provide the service-line for the connection but the petitioner had failed to do so and, therefore, water connection could not be released to the petitioner.

 

          Petitioner, being aggrieved filed the complaint before the District Forum with the allegation that the respondents were deficient in service as they failed to release the water connection to him in spite of the fact that he had deposited Rs.601/- with the respondent.

 

          District Forum dismissed the complaint, aggrieved by which, petitioner filed appeal before the State Commission, which has also been dismissed.

 

          It is not disputed before us that under Rule 13 of Rajasthan Water Distribution Rules, 1967, it is the responsibility of providing the service-line for water connection was on the petitioner, which he failed to provide.  We agree with the view taken by the State Commission that in view of provisions of Rule 13 of Rajasthan Water Distribution Rules, 1967 there was no deficiency on the part of the respondent.  Respondent could not have given the connection unless and until the petitioner had provided the service-line as per Rule 13 of the Rajasthan Water Distribution Rules, 1967.  Dismissed.
