1. This Review Application is filed by the Respondent/Complainant in Appeal No.341/2021 to review the order dated 28.03.2023.
2. The Commission examined the grounds of review Application and review papers coupled with order under Review dated 28.03.2023 and heard review applicant, who is personally present before the Commission.
3. In Consumer Complaint No.1820/2019, Review Applicant has obtained an award against OP, State Bank of India wherein, I Additional District Consumer Disputes Redressal Commission, Bengaluru directed OP Bank to expedite to process to get the interest subsidy to the complainant through the Nodal agency within three months from today and after receiving the same credit the same to the account of the Complainant. Further directed OP to pay interest at the rate of 12% p.a only on the said amount from 07.12.2015 till the subsidy amount is credited to the account of the complainant, as it had not processed the same even after three years after the complainant gave the papers to claim interest subsidy and directed OP to pay Rs.25,000/- as damages and Rs.5,000/- towards litigation expenses. It is this Order is assailed by OP in Appeal No.341/2021 before the State Commission and the State Commission after examining the materials placed on record by parties to the complainant held complainant has failed to prove to fits in the guidelines to seek subsidy interest under subsidy interest scheme, proceed to allow the Appeal. Consequently, set aside the impugned order dated 21.11.2020 passed in Consumer Complaint No.1820/2019 on the file of I Additional District Consumer Disputes Redressal Commission, Bengaluru, by recording reasons commencing from Para 4 to 9 which in our view could not be said such order passed requires review in exercise of powers vested under Section 50 of CP Act, 2019. In other words, we did not find any error apparent on the face of the record in the order under review. Hence, proceed to dismiss the Review Application with no order as to costs.
4. Send a copy of this Order to the District Commission and the parties concerned for their information and to complete the record. This order is said part and parcel of the main order.
