Heard both sides on the question of maintainability.  The opposite party very much depended upon the decision in U.P. Power Corporation V. Anis Ahmad (2003(3)KLTSN29(C.No.30)SC , wherein it is held by the Apex Court that “by virtue of section 3 of the Consumer Protection Act, 1986 or Section 173, 174 and 175 of the Electricity Act, 2003, the Consumer Forum cannot drive power to adjudicate a dispute in relation to assessment made under section 126 or offence under Section 135 to 140 of the Electricity Act, as the acts of indulging in “unauthorised use of electricity” as defined under Section 126 or committing offence under Sections 135 to 140 do not fall within the meaning of “complaint” as defined under section 2(1)(c) of consumer protection Act, 1986.” Complainant personally appeared and submitted that he would prefer to take resort before the appropriate Forum and hence seek permission to withdraw the complaint reserving the right to present the subject matter so.  The complaint is accordingly closed reserving the right to bring the subject matter before the appropriate Forum with the benefit of condoning delay for the period spent before this Forum.  Thus the above complaint stands closed.
