This I.A is filed by the opposite party challenging the maintainability of the complaint, stating that the dispute alleged is purely commercial transaction. Hence this Forum has no jurisdiction to entertain the complaint. Notice served to complainant and complainant filed counter and admitted that the connection availed for non domestic purpose and in the produced agreement also shows that the building is leased for business purpose.

2. Hence Forum found that the connection availed for a commercial purpose. Hence we found that this Forum has no jurisdiction to entertain such complaint.

Hence I.A.445/2017 is allowed and since challenging maintainability I.A is allowed the case stands dismissed.
