Final Order / Judgement

 

Mr. Ranjit Rajak, Ld. Advocate appears for OP 1 and 3 by filing fresh Vakalatnama and copy of Board Resolution by virtue of which his appointment has been made. He also files W/V with a copy to the other side.

Mr. Ranjit Rajak also appears for OP 2 and 8 by filing separate Vakalatnama. He also files W//V on behalf of OP 2 and 8 with a copy to the other side.

Miss Sampurna Saha, Ld. Advocate appears for Op 10. The Ld. Advocate of OP 4 and 5 are also present.

The Ld. Advocate of the complainant who is present before this Commission is directed to put in requisites within 7 days hence, for issue of notice to OP 9 and 11.

Fix 24.02.2022 for their appearance and asking them to file W/V within 30 days from the date of receipt of the notice.

The office is directed to render necessary assistance to the Ld. Advocate for issuance of the aforesaid notice.

The application for injunction i.e. MA/49/2020 is taken up for hearing.

Today is fixed for hearing of injunction application (i.e. MA/49/2020).

The Ld. Advocate of the complainant, the Ld. Advocate of the OP 4 and 5 and Ld. Advocate of the OP 6 and 7 are heard for against the prayer.

Fix 24.02.2022 for further hearing.

The interim order regarding blank cheques which are lying with the “India Bulls” will remain as it is tact until further order.

Fix 24.02.2022 for further hearing of the injunction application.

The Ld. Advocate appearing for the developers who has received Rs. 30,00,000/- from the complainant with promise to give a flat is directed to submit a clarification by the next date as to whether he is eager to hand over the flat under agreement and if so the date by which he will deliver the aforesaid flat to the complainant.

The application being no. MA/74/2021 is taken up for hearing.

The aforesaid application has been filed by OP 6 and 7.

Heard the Ld. Advocate for and against the said application.

Another application which is filed by the complainant for addition of parties is registered as MA/89/2021. The copies of petition are served upon the other side.

After hearing the Ld. Advocates on both sides the prayer of “Edelweiss Asset Reconstruction Company Limited” for treating it as a party is allowed. The MA/89/2021 is thus disposed of.

The complainant is directed to file amended complaint by the next date incorporating namely “Edelweiss Asset Reconstruction Company Limited”

Fix 24.02.2022 for order on the application being no. 74/2021 and also for further hearing of 49/2020.

Let plain copy be given to the parties free of cost as per CPR
