ORDER

The complainant has been absent all along the previous dates of hearing. The opposite party has filed an affidavit. It is stated in para 4 of the affidavit that the complainant has taken back all the jewels from the opposite party on 29.11.94 as the original suit was dismissed. Hence, it is stated that complaint does not survive for consideration. The complainant is not deligent in conducting the proceedings, and has not been cared to file the affidavit. In the circumstances we have no other alternative except to dismiss the complaint for default and non prosecution. The complaint is dismissed and no costs.
