ORDER.
The crux of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non refund of excess amount received towards purchase of cycle to the complainant for which the complainant sought for redressal of the grievances raised by the complainant.
On being noticed the O.Ps appeared through their learned counsel and defend the case..
Heard arguments from the O.Ps and from the complainant. Perused the record, documents filed by the parties.
This District Commission examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties touching the points both on the facts as well as on law.
FINDINGS.
Undisputedly the complainant has purchased one cycle 26T Non IBC Hero Finisher HD (Hardtrial) M.Red on payment of consideration a sum of Rs. 9,642/- (copies of the tax invoice is available in the file which is marked as Annexure-I).
During the course of hearing the complainant has filed Xerox copies of cycle box paper cutting where in the actual price of the cycle was mentioned as Rs.7,960.00. (copies of the cycle cover box paper cutting is available in the file which is marked as Annexure-1). The complainant argued as actual rate has been printed in the cycle cover box but the O.P. No.1 (dealer) had taken a sum of Rs.9,642.00 (copies of the tax invoice is available in the file which is marked as Annexure-2). Further the complainant also entitled the student discount a sum of Rs.1,000/- as per State Govt. order. The complainant argued he is entitled the differential amount which was received excess towards cycle purchase a sum of Rs.1,682.00 from the O.P. inter alia student discount a sum of Rs.1,000/- total Rs.2,682.00
In view of the above, considering the totality of the facts and circumstances inter alia material on record this commission considered view that the complainant is entitled to get Rs.2,682.00 from the O.P.
In the foregoing circumstances & with the above observation it appears just and proper being this is a welfare legislation to decide the matter the following orders passed for the best interest of justice.
Hence to meet the ends of justice, the following order is passed.
ORDER.
The O.Ps are directed to refund excess amount a sum of Rs.1,682.00 inter alia student discount amount a sum of Rs.1,000.00 total Rs.2,682.00 (Rupees two thousand six hundred eighty two)only to the complainant with in 3 days from the date of receipt of this order.
Parties are left to bear their own cost.
