            It appears from the case record that the Jdr Nos. 1 and 2 (5 and 6 in the original case) submit a report stating that they have handed over the decreetal amount amongst all the Dhrs. except Sl. Nos. 23 (Debendra Roy) and 24 (Sudhir Debnath) as they did not turn up to receive the amount.

            Heard. Perused the case record.

            It appears that there are 28 complainants in the original case and out of that Sl. Nos. 16 (Ajit Roy & Manik Roy) and 22 (Swapna Pandit) are not getting any award as per the order of the Hon’ble State Commission. So, the Jdrs. have to pay the drcreetal amount amongst 26 Dhrs. The decreetal amount has to be distributed as per order of this Commission as well as the Hon’ble State Commission. It also appears that out of said 26 Dhrs. Sl. Nos. 23 (Debendra Roy) and 24 (Sudhir Debnath) did not appear before this Commission to receive the payment of the award amount. It also appears that several attempts were made to inform them through their lawyer as well as other co-dhrs. Inspite of that they did not come forward to receive the award amount. Under these circumstances the share of award amount of Sl. Nos. 23 (Debendra Roy) and 24 (Sudhir Debnath) are undisbursed. The other Dhrs. have already received the award amount directly or their legal heirs by submitting authenticate documents. So, at this stage the case is dropped and filed against the Sl. Nos. 23 (Debendra Roy) and 24 (Sudhir Debnath) and disposed of in full satisfaction in respect of other 24 Dhrs who have received the award amount.
