Complainant has made this Complaint seeking relief against OP2.  Notices were served.  OPs have filed their pleadings.  Also Complainant and OP2 have filed their affidavits.  During the course of arguments, the Learned Counsel for the Complainant submitted that he may be permitted to withdraw the complaint with a liberty to file fresh Complaint on the same cause of action since there are certain inherent defects in the Complaint.  The Counsel for the OP2 has no objection in the matter.  In view of the above, we pass the following order:

ORDER

Complaint is dismissed with a liberty to the Complainant to file fresh complaint on the same cause of action.

Return extra sets and the Original documents if any to the parties concerned under the Regulation 20(3) of Consumer Protection Regulations 2005.
