- The complainant ordered a Realme-C11 mobile phone from the opposite party. Since the product received against cash on delivery was found defective, he wanted to return the same.
- Inspite of his continued efforts, the return process didn’t happen. Hence he made a complaint to the National Consumer Help line.
- Since the issue remained unresolved, he approached this Commission seeking a total relief of Rs.10000/- for deficiency in service, mental stress and cost.
- Notice was sent to the opposite party and they entered appearance, but did not file version.
- The Complainant has been continuously absent during the proceedings of the case. He has also not filed proof affidavit inspite of direction to do so or mark any documents in support of his pleadings. Hence taken for orders on the basis of merit.
- In the absence of version from the side of the opposite party, proof affidavit and documentary evidence from the complainant’s side, this Commission is left with no material to decide the case on merits.
- Hence the complaint is dismissed.
