Complainant/DHr and accused are present and requested orally to advance the case to today.  Hence case is advanced to today i.e., 04.08.2012.  As requested by both the parties, plea of guilty of accused is recorded and accepted.

 

It is seen in CC No. 82/2011 on 27.06.011 this Forum has directed the accused to recover certain amount from the salary of OP1 therein at the rate of Rs.1400/- per month and to pay it to the Complainant.  In spite of that order and in spite of this Execution Application No. 84/2012, accused has failed & omitted to comply with the order.  Hence, he has committed offence punishable u/s. 27 of C.P. Act.

 

It is submitted that Smt. Ramabai (29/10) of Primary Health Centre, Kasamballi, Bangarpet was transferred to Primary Health Centre, Bethamangala on 09.11.2009 and she is working there ever since that date.  This was not informed to this Forum either by the Decree Holder or by the JDr/Accused till today.

 

Hence, accused is directed to intimate to the Administrative Medical Officer, Primary Health Centre, Bethamangala and also this Forum to write to Administrative Medical Officer, Primary Health Centre, Bethamangala enclosing copy of Order passed in CC No. 82/2011 directing to recover the loan amount from the salary of Smt. M. Ramabai who is working there at the rate of Rs.2800/- per month and pay it to the Complainant forthwith till the entire loan is discharged.  Hence, we pass the following order:

 

ORDER

 

Accused is convicted for the offence punishable u/s. 27 of the C.P. Act and sentenced to pay fine of Rs.2,000/-, in  default, to undergo simple imprisonment for 3 months.

 

Write to Administrative Medical Officer, Primary Health Centre, Bethamangala, to recover the amount from the salary of Smt. M. Ramabai who is working in their office at the rate of Rs.2,800/- per month and pay it to the Complainant i.e., The Secretary, BEML Employees’ Credit Co-operative Society Ltd., Maharaja Road, Robertsonpet, KGF – 563 122 every month till the entire loan of the Complainant is discharged.
