JUDGMENT

                The  curx of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for  non refund of deposited  amount for the purpose of sale of land which  the complainant  sought for redressal of the grievances raised by the complainant. The brief facts of the case  has summarised here under.      

            That  the   O.P   made an   advertisement  by  public  notification had proposed

  to  give  a piece of land for the house site at the rate of Rs.50,000/- to be paid  at a time and  on completion of 6 years the O.P.  assured to deliver the  plot.  The O.P. through   his branch office  at  Rayagada had  started accepted  membership and collected deposit through  the O.P. No.3. The O.P. No.1 & 2 assured to deliver  the proposed  land on completion of the period of  6(six) years  and collected  Rs.50,000/- from the complainant and issued receipt in  favour of the complainant on Dt.17.10.2012 bearing customer ID No.3011044376.  The complainant  had paid  amount  for the purpose and sudden to utter suprise the branch office of   the O.P.  at Rayagada  had closed  during the month of January, 2015 without any notice to the complainant. Despite  repeated contact with the O.Ps from time and again the O.Ps are paid deaf ear and not  registered the plot  in favour of the complainant  instead of received  the considered price  of Rs.50,000/- from the complainant.   Hence this case. The complainant prays the forum direct the O.Ps  refund  money a sum of Rs.50,000/- with bank interest  from the date of respective  deposit  till  realization and such other  relief as the hon’ble forum deems fit and proper for the best interest of justice.

 

On being noticed  the O.Ps   neither entering in to appear before the forum nor filed their  written version despite availing  sufficient opportunity within these  10 adjournments. Complainant consequently filed his memo and prayer to set exparte of the O.Ps.  Observing lapses of around 1 years  for which the objectives  of the legislature of the C.P. Act going to be destroyed to the prejudice of the interest of the complainant.  Hence after hearing  the  counsel for the complainant set the case  exparte against the O.Ps. The action of the O.Ps is against the principles of  natural justice as envisaged  under section  13(2) (b)(ii) of the Act. Hence the O.Ps. set exparte  as the statutory period  for filing of  written version was over to close the case with in the time frame permitted by the C.P. Act.

We therefore proceed to dispose of the case, on its merit. We perused the complaint petition and the document filed by the complainant.

Heard from the complainant. Perused the record.

         FINDINGS.

          For determination  of this case the  point is to be answered.

          Whether there is any deficiency in service on the part of the opposite parties, if so can the complainant  is  entitle for the reliefs prayed for?

          It is apparent from the  documents filed by the complainant that he  had deposited  an amount  in the above organization.  In support of his   deposit of money by  the Complainant  is  filed  acknowledged by  deposit slip which are marked as Annexure-I,. Thus, it is clear that the complainants had  paid the consideration  to the OPs. After that the complainant  made several approaches to registered the land or   repay the said deposit amounts,  but the opposite parties kept silent. Moreover, there is no denial by the opposite parties  regarding the deposits made by the complainants. As per the document  it is clear that the opposite parties collected so much amount from the public not only from the complainant but also from the public  and these acts of the opposite parties clearly shows their  defraud all attitude and  amount to deficiency in service, hence, the opposite parties have to refunded deposit amounts to the complainant if not registered the land  with 9%  interest per annum from the date of respective deposit till the date of its  realization.

          The complainant with a great  hope invested  his hard earned  amount with the opposite parties, but because of the acts of the opposite parties, the complainant deprived of to get back her deposited amounts and  they have  moved  around the offices of the opposite parties and because of the acts of the opposite parties, they have  suffered financially and mentally for which the complainant is entitled to get.  Hence, to compensate we allow  Rs.5,000/- towards compensation besides costs of Rs.1,500. Accordingly, this point is answered.

          Hence to meet the ends of justice the following order is passed.

                                                ORDER.

          In  resultant the complaint petition stands allowed in part against the O.Ps on expartee.

The O.Ps ordered to   refund the deposited amount a sum of Rs.50,000/-  with interest @ Rs. 9% per annum from the date  of  respective deposit till realization  Inter alia  to pay Rs.5,000/-  towards compensation besides costs of Rs.1,500/-. The above order is to be complied within   60 days  from the date of receipt of this order. Service the copies of the order to the parties without charging any cost.
