ORDER
SRI.P.V. JAYARAJAN, PRESIDENT:
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The opposite parties 1 and 3 is not appeared before this Commission after admitting notice and hence opposite parties 1 and 3 were declared ex parte on 19/07/2019. Subcequently the complainant filed an IA No.91/2019 to delete the name of 2nd opposite party from party array and the same was allowed on 26/08/2019. When the case came up for consideration to day, it is noticed that the complainant is continuously absent and inspite of issuing notice by this Commission to the complainant, the complainant fail to appear before this Commission after accepting the notice. Hence, we find that the complainant is not willing to further proceed with the complaint. In the above circumstances we find that this is a fit case to be dismissed for default.
In the result the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
