ORDER

                   Mrs. Debi Sengupta, Member- Facts of the case, in brief, is that the complainant is a bonafide consumer of electricity under the Op. The complainant took a domestic electric connection being I.D. No.212077187 and since long he is enjoying electricity by paying electric bill regularly. The electric consumption of the complainant. Yearly is 1100-1200 units.

The complainant states that the collection of meter reading by the Op. is irregular and from the yellow card it is found that reading of electric meter is irregular and the complainant requested the Op. to collect the meter reading regularly but the Op. did not pay any heed to the request of the complainant.

In the month of June, 2014 the complainant decided to increase the load of her connection and applied for the same before the Op. and after getting the application the Op. decided to increase the load of service connection and

accordingly the quotation was issued on 04/06/2014 in favour of the complainant.  By that quotation the Op. directed the complainant to deposit Rs.5,258/- within 30/08/2014. The complainant deposited the amount on 12/08/2014 by two money receipt and after receiving the amount the Op. enhanced the load. Since then the complainant is enjoying the same.

After increasing the load the employee of the Op. took electric meter reading on 9/10/2014, 24/12/2014 and 28/03/2015 and send electric bill to the complainant and the complainant deposited the bill amount within time.

Again on 28/06/2015 the employee of the Op. took the reading of the meter of the complainant and from yellow card it is found that there is no reading.

The complainant further states that on the complainant received a bill dated 15/07/2015 and the complainant found that the previous reading is written as 3378 and present reading is written as 6492 and the total amount of Rs.27,043/- is claimed by the Op.  After receiving the same the complainant made a complaint on 20/07/2015 and disclosed that the bill send by the Op. is illegal and without any basis.  Thereafter the complainant requested the Op. to correct such illegal bill but the Op. disclosed that the complainant has to pay same otherwise the Op. will disconnect the service connection.

The complainant states that the average consumption of electricity of the complainant is yearly 1100-1200 unit. But the Op. illegally send bill of 3114 unit for three months which is without any basis at all and such act of the Op. is nothing but deficiency in service. Again the complainant went to the office of Op. and requested the Op. to rectify the bill. But on 28/08/2015, Op disclosed that if the complainant did not pay the bill amount then the service connection of the complainant will be disconnected. For such illegal activities of the Op. the complainant filed this case before the Forum praying for an order directing the Op. to correct the bill dated 15/07/2015 from the complainant.

The complainant also prayed for an order directing the Op. not to disconnect the service connection of the complainant.

Complainant also prayed for an order directing the Op. to pay Rs.10,000/- as compensation for deficiency in service and Rs.5,000/- as cost of the proceeding.

The Op. has contested the case by filing written objection.

Denying and disputing the case of the complainant it is stated by the Op. that the complainant is not maintainable in law and the complainant has no cause

to file such complainant. The Op. states that the complaint is not maintainable in law. According to the Op. as there is no deficiency in service on the part of Op., the complaint is liable to be rejected with cost.

Point for decision

                     Is the complainant entitled to get the reliefs as sought  for ?

Decision with reasons

                    In this case neither the complainant nor the Op. adduced any evidence, either oral or documentary. At the very outset, it is admitted by the Op. that the bill for the July, 2015 to September, 2015 was generated on the basis of the defective meter. But the said meter was noted by meter reader at the time of meter reading. Originally the connection load of complainant’s service connection was 41 K.V.A. Subsequently as per prayer of the complainant the connected load was enhanced upto 3.04 K.V.A. Now the calculation of consumption was made as per provision of W.B. Electricity Regulatory Commission Ltd. 07/08/2013, 22/03/2014 to 26/06/2014 for 96 days consumption was shown 453 unit against 41 K.V.A. load for 1 day consumed 453/0.41 X 96=453 X 3.04. Disputed bill for the period July, 2015 to September, 2015 i.d. 28/03/2015 to 25/06/2015 for 89 days with connected load. 3.04 K.V.K. In view of the above question 3.04 X 89/0.4 X 96=3113.90=3114 unit. So in consumption to previous years consumption for the same period with enhanced connected load complainant consumed 3114 unit. The bill has been correctly  raised as per provision of WBERC. Therefore we are of the view that the present case is not maintainable.

                                         Hence, it is,

ORDERED

 

                                                                 that the complaint case no.99/2015 is hereby dismissed on contest but in the circumstances without cost.
