Brief Facts of the case
Complainant booked a taxi from OP for going honeymoon trip to Sarai Rohilla railway station, Delhi on 27/02/2015 at 430 am, but taxi did not reach at the booking address in time. Despite of confirming from OP, who assured complainant that taxi would reach in time and OP had sent driver’s detail on his mobile. Even at the scheduled time, taxi did not reach, so complainant had to cancel his trip which was booked from train. Later complainant hired some private car and went. By this act of OP where OP had assured for sending taxi well in time, did not fulfill the promise and reverted by sending the SMS that OP missed the phone call and realized their mistake.
As per the complainant, lot of humiliation among his relatives with financial loss occurred due to the callous attitude of OP, so filed this complaint for compensation for mental agony and harassment for Rs 15,000/-with Rs 3000/- as litigation charges.
Despite of receiving the notices sent repeatedly, none put appearance for OP, so case proceeded Ex Part. Complainant submitted Ex Parte evidence on affidavit and affirmed all the facts narrated in his complaint as true and correct which were on record and were not controverted. Arguments were heard and order was served.
We have scrutinized all the facts and evidences submitted by the complainant and presumed to be correct. Though we could not find any evidence pertaining to honeymoon trip as marriage card, railway booking tickets as booked and also there was no bill for private car used up to railway station. Only complainant had submitted SMS received as confirming the taxi booking and would reach in time, but regretted for not receiving complainant’s call.
Being this a Exparte case and evidence submitted on affidavit has been presumed to be correct, so we allow this complaint and pass the following order-
The order copy be sent to the parties as per rules and file be consigned to the record room.
