The revision petitioner is the opposite party in CC.203/2010 in the file of CDRF, Idukki. The revision petition is filed over the order of the Forum in the IA filed contending that the petition is not maintainable. The Forum has dismissed the IA.
2. It is the contention of the counsel for the revision petitioner that the complainant has successfully completed the course and thereafter he has sought for refund of the course fee and hence the complaint is not maintainable. It is also contended that the complainant has signed in the document containing the terms and conditions wherein it is not mentioned that placement will be provided. It is further contended by the counsel that it is specifically mentioned in the terms and conditions that the institution is not obliged to provide placement. We find that the above all are matters that has to be adjudged by the Forum. The contention that the complaint is not maintainable cannot be sustained. We find there is no illegality at all in the order of the Forum. There is no scope for admitting the revision petition. The revision petition is dismissed in limine .
