The appellant is the opposite party/KSEB in CC:27/09 in the file of CDRF, Kottayam.  The bill issued by the appellant back assessing

 

for the period from 8/03 to 8/05 for a sum of Rs.5,160/- stands cancelled.

2. The Forum has relied on Regulation 33 clause 2 of the Conditions of Supply as per which the average consumption for the previous 6 months is to be taken and the bill issued and in case the same is not possible only the average consumption after replacement of the meter is to be taken.  The meter is to be replaced within one month.

3. It is pertinent to note that the back assessment is for a period of 2 years.  We find that the above action of the appellant result in much inconvenience to the consumer.  There is no proper explanation for not replacing the meter for a period of 2 years.

4. In the circumstances we find that there is no patent illegality in the order of the Forum.

5. There is no scope for admitting the appeal.

 The appeal is dismissed in-limine.
