This revision petition by the Citi Bank has been filed under Section 21 of the Consumer Protection Act, 1986 against order dated 6th December, 2012, whereby the Delhi State Consumer Disputes Redressal Commission (for short he State Commission has ordered ex-parte proceedings against them in First Appeal No. 563 of 2012. In the impugned order, it is recorded that despite service on all the opposite parties, including the petitioner bank, nobody had entered appearance on their behalf before the State Commission when the appeal was listed for hearing on 6th December, 2012. Having heard learned counsel for the petitioner and the respondent-complainant, who is present in person, we are of the view that having regard to overall facts and circumstances of the case and in order to avoid further delay in disposal of the complaint on merits, ends of justice would be sub-served if the impugned order is set aside and the complainant, respondent no.1 herein, is adequately compensated for the inconvenience caused to him because of the non-appearance of the opposite parties before the State Commission on the date of hearing. Accordingly, we set aside the impugned order and grant one opportunity to the petitioner to enter appearance before the State Commission for further proceedings on 10th March, 2014, when the appeal is stated to be listed before the State Commission, subject to their paying to respondent no.1 (Tek Chand) a sum of Rs.15,000/- as costs. The said amount shall be paid to him before the State Commission on the next date. The revision petition stands disposed of on the above terms. |
