PER SHRI A. Z. KHWAJA, HON’BLE PRESIDING  MEMBER.

            Appellant and advocate both are absent.  Mr. Chichbankar, advocate is present for the respondent No. 1. On perusal of record the respondent  No. 1 has filed  an application  for  direction to the appellant  to supply appeal compilation  but  appellant has not  supplied the appeal compilation  to the respondent No. 1 till today. Today also the matter is fixed for hearing on admission but the appellant and advocate  both are absent.  Record reveals that  on earlier  several dates  appellant has remained  absent though the matter is fixed for hearing on admission.  It appears that the  appellant is not  keen to  pursue  the appeal. As such  the  appeal is hereby  dismissed in default.
