This appeal has been filed against the judgment dated 30.7.2013 passed by the learned DCF Sawaimadhopur by which the complaint was allowed.

 

This appeal was filed with delay of 479 days and this delay was condoned by our order dated 28.7.2015 in which we held that appellant had not been properly served and the judgment was made in a haste.

 

In view of these facts, we are of the view that this matter should be remanded back to the DCF for deciding it afresh. The learned counsel for the respondent is also present and we direct both the parties to appear before the DCF on....................... The appellant would file their written statement before the DCF on the same day and thereafter the matter will be decided on merits.
