  1. On 16-06-2015, the complainant had purchased a new display screen of laptop at a cost of Rs. 6000/-.  The screen was purchased from OP vide retail bill/ invoice no. TL/ M15/ R688 dated 16.06.2015 and carried 3 months warranty. The screen however developed serious problem immediately after installation. A small crack had developed on the screen from inside which was noted by the complainant on 18-06-2015 the day it was used for the first time after installation. The complainant informed the OP about the defect on 19-06-2015 and visited the service center of OP on 20.06.2015.  The OP assured that the defect will be removed.  The complainant visited the service centre on 26/06/2015 and was informed that the laptop has been sent to another service center.  The laptop was however returned to the complainant on 27/06/2015without carrying out any repairs. The complainant has taken up the matter with OP several times but to no avail.  Hence the complaint.
  2. The OP was served with copy of the complaint. It chose not to appear and contest and was thus proceeded with ex-parte.
  3. In his ex-parte evidence the complainant has filed his own affidavit dated 25-11-2016 and has corroborated the contents of the complaint.
  4. We have heard arguments advanced at the bar and have perused the record.   The complainant has placed on record a copy of the invoice for Rs. 6000/- vide which he had purchased the display panel from the OP.  He has also placed on record the job card showing that the display panel had some defects and it was returned to the complainant without repairs.  A copy of legal notice which was served upon the OP has also been placed on record.

As already stated that the OP has failed to contest the complaint and give its version.  The affidavit filed by the complainant has remained uncontroverted with.  Keeping in view the documents placed on record as also the affidavit filed by the complainant, we are convinced that the OP was deficient in rendering services to the complainant. Accordingly we direct OP as under:-

  1. Pay  a sum of  Rs. 6000/- to the complainant along with interest @ 10% p.a. from the date of institution of this complaint i.e. 23.03.2016 till payment.
  2. Pay to the complainant a sum of Rs. 5000/- as compensation for pain and agony suffered by the complainant  which include the cost of litigation.
  1. This order shall be complied with by the OPs within a period of 30 days from the date of receipt of this order failing which interest @ 10% shall be payable on the entire above mentioned amount from the date of this order till realization.  Copy of this order be sent to all the parties free of cost  as per law.  File be consigned to Record Room.
