Final Order / Judgement

The Ld. Counsel for the complainant is present by filing Hazira. The complainant is also present in person.

            Today is fixed for either filing settlement petition by the complainant or adducing evidence as a last chance.

            Today the complainant has filed a petition supported by Affidavit stating that the dispute by and between the complainant and the OP has already been resolved out of the Court by way of amicable settlement. It is stated by the complainant that as his grievance has already been settled by the OP, he is not inclined to proceed with this case and prays for withdrawal of this complaint. According to the complainant if this application is not allowed he will suffer irreparable loss and injury and prayer is made by the complainant for allowing this application.

            We have carefully gone through the content of the application along with the money receipt as annexed with the application, from where it is evident that the dispute has already been settled out of the Court by and between the complainant and the OP and as the complainant is not interested to proceed this complaint further, hence

it is ordered that the complaint being no.96/2019 is hereby dismissed as withdrawal in view of the petition filed today by the complainant.

Let plain copy of this order be given to the party/ies free of cost as per CPR, 2005.
