     Learned counsel Mr. C. Bhattacharjee is present on behalf of the petitioner.

     Heard learned counsel Mr. Bhattacharjee.

     In the line of the complaint petition learned counsel Mr. Bhattacharjee submitted that complainant filed a case before this Commission bearing No. CC/5/2021 against the opposite parties, but the summons upon the opposite parties could not be serve for which the case was dismissed. Subsequently, the complainant collected the new address of the company and filed case No. CC/4/2023 on 13.03.2023. In the process there occurs a delay for 150 days and in order to condoned the delay this Misc. Application bearing No. 02/2023 has been presented.

     Considered the grounds which necessitated the delay and after hearing the learned counsel this Commission of the view that delay of 150 days in filing the MA/2/2023 is justified and accordingly it is condoned.

     This MA/2/2023 is thus disposed of accordingly.
