      The gist of the complainant’s case is that he purchased a Godrej  Air  Conditioner and the same was not functioning properly for the last few months and hence on 16/3/13 the complainant approached  the service centre conducted by the opposite party .  The   service personal came  to the house of the complainant and repaired the defective Air conditioner.  When the complainant tried to function it,  there was  some  abnormal sound  and vibration to the A/c and the device  started to remove itself from the  socket and now the display board of the A/C is hanging down.    Thereafter  on several occasions the complainant tried to contact the service  centre for the  assistance of a senior technician for the repair, opposite party failed to provide any service, hence the complaint.

2.   Notice  was issued to the opposite party and  he appeared  but not filed any version even after  many posting  dates, hence his name was called and set exparte.

3.  Complainant was examined as PW1 and Ext.A1 receipt of Rs.400/- was marked.  On perusal of Ext.A1 it can be seen that the opposite party repaired complainant’s defective Air conditioner and when  PW1 tried to operate it, it was again found defective now it is in a danger position by hanging its display board and there is a leakage  also.  On repeated request, the opposite party  has not turned up to repair  the defects especially during this summer season the PW1 had to suffer a  lot.  Opposite party once appeared before the Forum, but failed either to  settle the case or to contest the case by filing version.  Therefore PW1 is entitled for a relief from this Forum for deficiency  in service on the part of opposite party.

   In the result the opposite party is directed to repair the defective air conditioner and he is further directed to pay Rs.3000/-  as compensation and Rs..2000/- as cost of this proceedings.   Time for compliance is limited to 30 days from the date of receipt of copy of the order.
