JUDGEMENT
Ld. Counsel for the OP has drawn the attention of this Commission to the settlement arrived at between the parties after filing of the present complaint. The document which is titled “Discharge” shows that the complainant Sh. Suresh Dutt Sharma has admitted the signature(s) of his wife thereon. It is also admitted by the complainant Sh. S.D. Sharma that the said settlement was entered into after filing of the present complaint. The complaint was filed by the complainant on 19/7/2011.
A careful perusal of the settlement (which is exhibited as C-1 at the time of dictating these orders) shows that the Complainants have admitted that their claim stands fully satisfied, complainant having received an amount of Rs. 6 lakh from the OP. The relevant portion of the settlement is reproduced below:-
“Henceforth, there shall be no claim by me against TDI Infrastructure Pvt. Ltd. and its Associate Companies its Directors, Officials and Staff which relates to my/our Advance Registration Application Form.
I/we further undertake to withdraw all my/our claims, notices, letters and complaints be if civil or criminals which were made by me/us pursuant to the Advance Registration Application Form.”
The complainant having entered into a settlement with the OP and also having received an amount of Rs. 6 lakh towards the said settlement, cannot be allowed to continue with the present complaint. The same is hence disposed of as compromised.
