          Complaint filed by Deepak Kumar was allowed by the learned District Consumer Forum, Sonepat by directing the opposite parties to refund the amount of Rs.9,90,527/- alongwith interest @ 9% per annum from the date of filing of the complaint till its realization.  The complainant filed an appeal against the order of the learned District Forum seeking refund from the date of deposit instead of date of filing of the complaint.          

2.      The plea was accepted by the Commission by directing refund of the deposited amount alongwith interest @ 9% per annum from the date of deposit till its realization.

3.      Aggrieved from the order of the Commission, the opposite parties filed the present miscellaneous application for review/recalling of the order of the Commission.

4.      Once the Commission has disposed of the appeal by directing the refund of the deposited amount alongwith interest @ 9% per annum from the date of deposit till its realization, the only remedy available to the opposite parties was to move the Hon’ble National Consumer Commission, New Delhi instead of filing the present application for review/recalling as the Commission has no power to review/recall its order.

5.      In view of above, the application is hereby dismissed being not maintainable.
