Complainant called out absent. No representation on behalf of complainant. OP is present. This is the mater is of the year 2019. 

On the last date of hearing i.e. on 14.10.2022 this Commission has observed that no representation on behalf of complainant.

On perusal of the previous order sheet dated 20.09.2022 and 14.10.2022, it is noticed that on the said two dates, this Commission was observed that on perusal of the order sheet it is noticed that this case was posted on 01.04.2021 since then till today in spite of sufficient opportunities were given for more than 1 ½ years, the complainant does not turned up and not shown any interest to file affidavit of complainant.  Hence, on 20.09.2021 this case was adjourned on cost of Rs.1,000/- for filing affidavit of complainant.  Again on 14.10.2022 one more opportunity was given to the complainant and adjourned on payment of further cost of Rs.500/- and posted to  this day for filing affidavit of complainant as last chance, even then complainant not present and not filed affidavit, it shows that the complainant is not interested to proceed with the case.  Therefore, the complaint of the complainant is dismissed for non-prosecution/ default.
