Counsel for the parties state that a settlement has been arrived at between the parties. Respondent has agreed to pay Rs.12 lakhs to the appellant in full and final settlement of the dispute between the parties. Counsel for the respondent has brought a cheque drawn in favour of Ajay Industrial Corporation Ltd. in the sum of Rs.12 lakhs. The cheque has been wrongly prepared. The appellant is not a limited company. Counsel for the respondent states that he shall hand over a fresh cheque of Rs.12 lakhs in favour of the appellant i.e. Ajay Industrial Corporation to the counsel for the appellant on or before 08-10-2012. In view of the settlement arrived at between the parties, the appeal is dismissed as infructuous. Amended memo of parties is taken on record.
