Final Order / Judgement

            This  is  a  complaint  filed by the  complainant Soumendra Pradhan U/s. 35 of C.P.Act, 2019 for  certain reliefs against the opp.parties.

2.       The  case  of the  complainant is that on 07.05.2021  he  took a  new connection to  his house  supplied by  the TPCODL  vide  consumer No. 80022189650 bearing  meter Sl.No. TS 146394. The  status of the  meter  was  Zero unit. On 12.02.2022  a  electric bill was supplied to  him, in which  the date of  installation of the  new meter was shown as  25.12.2021  instead  of  actual  installation date  07.05.2022. The  status  of the  said meter  was  shown  as 1104 units. No previous bill was   supplied  to the  complainant as  required  under  law. The  opp.parties  illegally calculated  different charges and the bill amount was Rs.6722.36 with arrear shown as Rs.2660.00. The  complainant approached  the  opp.parties repeatedly  for correction of  the  mistake  appeared  in the  bill supplied to  him. The  opp.parties  did not  take  any step for correction of the mistake. So on 15.02.2022 the  complainant  lodged  a complaint  before  the opp.party No.3  for  revision. No  further communication was received from  opp.party No.3.

          Again   on 13.03.2022  another electric  bill was supplied  to the  complainant  by  opp.party No.3 & 4. In the  said bill  the  status of the meter  was shown as  1194 units i.e  90 units consumed .Again in the  said bill the  opp.party No.3 & 4 has  given a  wrong  calculation  and the total  amount imposed on the  complainant  was Rs.9827.09 paisa. The  complainant raised his  complaint  against such in correct bill. As  no action was  taken by the opp.parties for  revision of the  electric  bills supplied to the complainant, this complaint is  filed before the  Commission.

3.       Notices were issued  to all the opp.parties through Regd. post with  A.D on 24.08.2022. The  complainant  submitted  the  track consignment  report  relating  to  the  notices issued to the opp.parties. On perusal  of  the  documents available  on the  record it is  clear that  notices  were  served on all the opp.parties. The opp.party No.2  appeared  and  filed a  written statement on behalf  of  all the opp.parties. 

           The  case of the opp.party No.2  is that initially there  was  power supply to the  house of the  complainant  vide  consumer  account No. 03900439/80022189650. It was a domestic  connection  with connected load  1K.W since  07.05.2021. Annexure-1 is  the   photo copy of  the billing abstract. The  first bill  was generated  during 8/2020-2021 on estimated basis  and  continued upto 02/2022.During March, 2022  the  energy bill was  served  on the  complainant  on actual meter reading basis  with initial meter reading  as  1104 units. The outstanding dues  upto  03/2022  as per  data base was 9050 units. Thereafter,  from  March, 2022 onwards the  electric bills were  issued to the  complainant  as  per  the  actual  consumption and  meter reading. After receiving   the complaint  from the complainant  the electric  bill from 07.05.2022 to 12.02.2022  has been  revised  as  per the  actual meter  consumption by taking the total consumption as 1104 units from 05/2021 to 02./2022. The average  meter reading was  calculated  as 110.40 units   per  month from 05/2021  to 02/2022  and an amount of  Rs.4841.72 has been withdrawn. Further   the   DPS amounting  Rs.628.29paisa  claimed  from  08/2021 to 08/2022  has  also  been withdrawn . Annexure- 2  is  the   photo copy of  the revised  statement. The total  withdrawal  amount  was Rs.5470.01 paisa  which  has been credited  to the account of the  consumer in the   month of August, 2022  by  the   Section Officer. With reference  to the  amount of Rs.73219.71 paisa  which was charged has been debited  under  sundry adjustment (adjustment  against faulty meter) in the  bill issued on 14.08.2022 . The  opp.parties has been rectified the said  amount as  per  the standard operating procedure and  the  same amount  has been credited to the consumers’ account, which is  shown  in Annexure-3. The bill revision  has been  done  as the consumer  has  got  a new connection on 07.05.2021  through the meter  number TSO-106394 and the  said meter  exists in the  residential   house of the  complainant now. The copy  of the  meter installation  report dtd. 07.05.2021  is annexure- 4. There is absolutely no negligence and there  is no deficiency in service  provided by the opp.parties  to the complainant. The opp.parties  denied  the  other  allegations made in the  complaint. The  complaint  filed  by the complainant  be rejected.

4.       The  complainant in his  complaint petition  has alleged that there is  a new connection to  his residential  house  by the opp.parties on 07.05.2021 bearing Consumer No. 80022189650 having meter Sl. No. TSO 146394 with reading zero unit. It is  further alleged  that   on 12.02.2022 the  first electric  bill  was supplied  to the  complainant in which the  date of installation of the meter  was shown as 25.12.2021  instead of 07.05.2021. Perused the meter changed report dtd.07.05.2021  which was issued to the  complainant by the opp.parties. On  perusal of the said  report it is clear  that   a new  connection was  given to the complainant only on 07.05.2021. The opp.parties  filed  their  written statement   through opp.party No.2 .At  paragraph-1  of the  show cause  it is admitted by the opp.parties that  a new  domestic electric  connection  was supplied  to the  complainant  on 07.05.2021 having  account  number  03900439/80022189650. From Annexure- 1 it appears that  there  was  no meter reading  from  date of  installation of the meter upto 07/2021. The Annexure- 1 shows  the detail calculation of the  unit  charge amount demanded from the complainant. Annexure- 2 &3 also  shows the  amount  of  money  adjusted by the opp.parties  and deposited in the consumer  account  of the  complainant. The opp.parties have adjusted  all the  amounts  which were  due to the opp.parties  and  deposited the surplus  amount in the consumer account of the  complainant  by means  of  adjustment. Soon after receipt  of the complaint  from the  complainant the opp.parties have  taken  prompt  action  and  adjusted the  amount. Although  it is  alleged by the complainant that  he has  approached  to the opp.parties  in several occasions  regarding  the defects  in the  bills issued  by  the opp.parties, he has not  produced any evidence before  this  Commission to prove the same.  The  complainant  failed to  prove that on 15.02.2022 he has submitted a  letter to S.D.O Electrical ,Talcher. However, in  the  case in  hand  soon after receipt of the complaint the opp.parties have  taken all  the necessary steps  for revision of  the  energy bill and withdrawn the  amounts  and  deposited  the same  in the  consumer account of the   complainant. So there is no   deficiency in service  by the opp.parties as  they  have  promptly acted on  the  complaint.

           The  case be and the same  is  dismissed  on contest against the opp.parties.
