Final Order / Judgement

1.       This  is  a petition U/s. 35  of C.P.Act, 2019 filed by the  complainant.

2.     The  case  of the  complainant is that ,  he  is a bonafied resident of  Vill.- Baniabahal under Angul District and   consuming electricity having   old consumer No. 703-A- 10287 ,corresponding  to  new consumer No. 01342161. The  meter was  in  the name  his  father   namely Late Ashok Ku. Mishra. The connected  load was 1 K.W under domestic category. As  the  kids of the  family members  of late Ashok Ku. Mishra were  prosecuting their  studies , they were staying at Bhubaneswar and  rarely used to  come to Angul. During last 2-3  years the meter reading  varied from 140 to 170  units  per  month as  per consumption. On 17.08.2020  the care taker  of the house of the  complainant intimated  him that  two  numbers of  ceiling fans are   not functioning  due  to  lightning. It is  pertinent to  mention here that  due to Covid-19, the meter reader of opp.parties did not  come  to the house of the  complainant to take  reading from the month of  February, 2020 to July, 2020. Due to  non-supply  of  electric  bill the    complainant  could not pay the bills  for the  said  period. On 21.08.2021 the meter reader  of the opp.parties  visited  the house of the  complainant and  submitted a electric bill  to the   care taker for the  month of March, 2020 to July, 2020. When the  complainant came  to Angul  on 01.09.2020  he  was  shocked  by seeing the  electric  bill  as the  units consumed  was  19886 units . The  reading  was  abnormal. On personally  verification the  complainant  came  to  know that the  meter was not  functioning  properly   as it  was burnt  due to  lightning. On the  next day  the  complainant  submitted a written report  to the opp.party No.2 and requested to replace the meter and  re-consider  the bill amount  as per the  average electricity  consumption. The opp.party No.2 has acknowledge the written complaint  but  did not take any step  till 14.09.2020.Due to such delay   the  complainant has suffered much mental pain and  agony  .He  submitted  another written  report to opp.party No.2  on 14.09.2020  to replace the meter  and install  a  new  one. Only on 14.12.2020 the opp.parties  have  installed a  new meter  vide Sl. No. TS 0040922  and  supplied  the  meter  change report to the  complainant. Since  04.12.2020 the  meter reader of the opp.parties is  taking meter reading  but  not supplying the  bills on the  ground that the  dispute  has not been resolved. Seeing  no result  on his  request, on 12.08.2020 the  complainant  submitted a reminder  to opp.party No.1 to settle the dispute  but in vain. The disputed  bill for the period  from March, 2020  to 04.12.2020  and  the  electricity  bill  be  revised legally  by  following provisions  of OERC Regulation by taking  into average of  three- six  months consumption of electricity. On 15.01.2020  and 30.03.2021 the  complainant has  paid an amount of Rs. 11,000.000 & Rs. 10,000/-  respectively. There  is  deficiency  in service on the part of the opp.parties  for which   the  complainant  suffered mental  agony .He is entitled  to a compensation of Rs. 1 lakh from the  opp.parties.

3.       Although the opp.party No.1. filed   his written statement, they have not  contested the case.

4.     The complainant has  filed  his  affidavit  evidence and  exhibits 1 to  7 are marked  on his behalf.  Exhibit-1 is the application dt.14.09.2020 submitted  by the complainant to the Executive Engineer, TPCODL. Exhibit -2 is also  another representation of the complainant to the said  Executive Engineer dt.07.09.2020. Exhibit-3 is meter  change report. Exhibit-4 is   extract of consumer  billing statement from the  consumer billing  ledger  of the opp.parties. Exhibit -5 is   the application  submitted by the complainant to opp.party No.1 on 12.08.2021. Exhibit-6 is   the copy  of the death certificate of the father of the complainant. Exhibit-7 is   the  photo copy  of the legal heir certificates, showing the  complainant  as the son of Late Ashok Kumar Mishra.

5.      Perused the complaint petition, affidavit evidence of the  complainant  and the documents  proved  by him. We  found  sufficient  force in the submission the learned counsel for the  complainant  for the  reliefs claimed. Although  the opp.party No.1 has  filed the   written statement, but they  did not turn-up  to contest the case. There is  no reason to disbelieve the sworn testimony of the  complainant.

6.       Hence ordered :-

: O R D E R :

          The opp.parties are directed not to disconnect the power supply  to the complainant’s  residence  bearing New  Consumer No. 01342161. The opp.parties  are  also directed  to  revise the  electric  bill  for the  period  from March, 2020  to December, 2020  by taking  average  monthly consumption as per the  new  installed  meter  by  following the  OERC Regulation and   re-caste the electric  bill  afresh and to  change the  ownership of the  consumer in the  name of the  complainant  after death of his  father late Ashok Ku.Mishra. The opp.parties  are  directed to comply the  order of this  Commission within one month from the date of receipt of this  order and submit  the  fresh  bill to the  complainant and the complainant   is  bound to  deposit the charges as  per fresh bill after   deducting the amount already paid by  him  within a  period of  15 days  from  receipt  fresh bill  from the  opp.parties  without fail.

          The case is disposed of  accordingly without  contest.
