Today the case is fixed up for arguments. However, Sh. K.B.Sekhon, Counsel for complainant has made statement that he wants to withdraw the complaint with a permission to the file afresh at Bathinda.

We have heard the ld counsel for the parties. Counsel for Ops has not objected to the requisite permission but has sought direction to the effect that requisite permission be granted subect to the cost.

Arguments heard. Instand complaint was filed by Nahar Singh complainant and OPs put an appearance on 24/04/2010. By this time, a period of 6 months has already elapsed. In our view, requisite order of withdrawal with a permission to file it afresh at Bathinda deserves to be passed.

In this view of the matter, complainant is directed to withdraw the complaint. He is granted the requisite permission to file if afresh at Bathinda due to techincal defect on the ground of jurisdicition subject however to Rs. 1000/- as cost which shall be deposited in Consumer Legal Aid Account. File be consigned to record room.
