1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.

2. This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint, notice was issued to the opposite party. The opposite party entered appearance and filed written version denying the allegations raised by the complainant. When the case came up for consideration on 20/07/2023, both parties were represented and submitted that there is a chance of settlement and hence the matter was referred for mediation. When the case came up for consideration today both parties were present and submitted that the matter is settled. Compromise memo signed by both parties is also filed before this commission. As per the compromise the opposite party agreed to pay Rs.8500/- (Rupees eight thousand five hundred only) being the value of the tyre on production of bill receipt of the replaced tyre. The opposite party agreed to perform their parts of the terms of the compromise within three weeks from the date of production of bill by the complainant. The compromise memo is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of compromise.

                In the result, the complaint is allowed in terms of compromise. The compromise memo dated 05/08/2023 shall form part of this order.                   

                 A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
