ORDER   (Passed on 31.10.2012)   Per Smt J D Yengal, Hon’ble Presiding Member   None for the appellant is present. Their counsel Mr Kalyani is also absent. Adv. Mr Mr Mewad for respondent No.1 & 3, Adv. Mr Dahiwale for respondent No.2 are present. The record reflects that counsel for the appellant has sought adjournment twice on previous two dates, which was granted subject to payment of cost to be paid to the respondents. However, counsel for the respondents submits that they have not received the cost. Hence, it is presumed that the appellant is not interested in prosecuting the appeal.    Therefore, this appeal deserves to be dismissed in default and accordingly, it is dismissed.    No order as to cost.   Copy of this order be supplied to the parties.
