Present application for transfer has been filed seeking transfer of First Appeal No.698/2009 filed by the respondent which is pending before the State Commission of Maharashtra to any other State Commission on the ground that his complaint was allowed by the President and another member whereas the dissenting member Mrs.Deeplaxmi Mahase dismissed the complaint; Mrs. Deeplaxmi

Mahase happens to be the wife of President of the State Commission.  Petitioner has shown his apprehension that he would not get justice from the State Commission.  Although, we are not convinced with the reasons given by the petitioner for transfer of the appeal, but still to remove the apprehension of the petitioner, we direct that the First Appeal No.698/2009 pending before the State Commission of Maharashtra be transferred to the State Commission of Delhi.  Counsel for the parties state that the State Commission at Delhi would be more convenient to the parties. 

The State Commission of Maharashtra is directed to transfer the file of First Appeal No.698/2009 to the State Commission of Delhi for adjudication.
