Final Order / Judgement

Heard on the point of admission.

Briefly the case of the complainant is that he purchased a “Tata Prima Tipper LX 2523” from OP No.2 in the month of April, 2016. The vehicle is registered with the DTO Mansa vide registration No. PB-31P-3821. The vehicle was giving the problems. The complainant reported the problem to OP No.2 and to the service station of OP No.1. Both had directed the complainant to visit the nearest service station. Accordingly, the complainant visited the office of OP No.3 to redress his problem. OP No.3 delayed for 75 days to deliver the vehicle after repair. Complainant has suffered loss due to the delay. The complainant has claimed compensation of Rs. 4,50,000/- on account of delay in repair.

We have heard learned counsel for complainant regarding territorial jurisdiction.

Learned counsel for complainant has submitted that the vehicle was got registered at Mansa. The complainant approached OP No.3 at the instance of local service station of OP No.1. Hence the Forum has jurisdiction to decide the case.

We have given carefully consideration to the submission.

The complaint is against the OPs having office at Chandigarh and at Barnala. The repair was got effected from Barnala. The compensation is claimed for delay in service by the service centre at Barnala. Therefore, the cause of action arose against the service station at Barnala. This Forum has no territorial jurisdiction to entertain the complaint. The complaint is ordered to be returned to the complainant.
