J U D G M E N T

MRS  SUSMITA MISHRA, PRESIDENT  :

The Consumer complaint case No. 27/2022 is posted today for order. We perused the record and so also the order-sheet available on record. The complainant namely Bijay kumar Sahoo filed this Consumer complaint against the above- named O.ps ( Tata Motors Finance Ltd,)  U/sec.35 of the C.P.Act,2019 with allegation stated therein  and praying for :-

“  Direct the O.Ps to make good of the loss of the complainant amounting to Rs.8,00,000/- . and pass any other and / or further order/ orders as deemed..”            

            After issuance of Notice by this Commission the O.ps have filed the written version. Objection against the Interim petition and non-maintainability petition along with documents as per list. Copy served to the complainant on 30.04.2022 with objection.

                        Heard.

We have gone through the case record and perused the entire order sheets and on repeated calls nobody turned up except the counsel of the O.Ps. In the mean time, many dates have gone neither the complainant has filed any objection nor took any steps regarding hearing of the Interim petition along with main case. Moreover, after several opportunity, the complainant has remained absent from  15.02.2023 to till 27.10.2023. It  seems that the complainant is not interested to proceed  with this case further .

Hence, the present Consumer complaint is hereby dismissed due to non prosecution.

Accordingly ,  the present C.C.Case 27/2022  is disposed of.  No order as to cost. Pending Interim Application if any, also stands disposed of

                        Issue extract of the order to the parties concerned.
