 Judgment

            Parties are present through their respective Ld. Advocates. On earlier occasion the complainant filed an application praying for withdrawal of this complaint on the ground that the grievance of the complainant has already been redressed by the O.P amicably out of the court. For this reason, the complainant is not inclined to proceed with this complaint further and prays above money.

 

            No objection is raised by the O.P.

 

            Considered. In our opinion that as the complainant is not agree to proceed with this complaint further as the grievance has already been settled by the O.P out of the court, hence the application filed by the complainant should be allowed.

            Hence,

                           it is ordered,

                                                   that C.C. No. 391/2016 is hereby dismissed for non-prosecution without any cost based on the application filed by the complainant.

 

Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
