ORDER

Heard learned advocate for the complainant. Present complaint hs abeen filed against the OP alleging deficiency in service from the part of the op through not delivery the TATA Nano Car by the OP in the light of the order of booking and payment of a sum of Rs.95,000 paid through demand draft dated 24.07.2009. But throughout the petition of the complaint filed complainant has not produced any document to show the date of above reffered demand draft was any when sent to OP and the amount of draft was credited in the account of OP. No document acknowloging receipt of the booking money has been produced.

         A part from above the present complaint has been filed after 15 years from the date of booking against the stiputlated period of 2 years only prescribed limitation for filing a complaint. Even advocates notice regarding non-delivery of the goods booked has not been filed which could have given rise to the cause of action plus the complainant is the present complaint hopelessly barred by limitation. Hence the complaint is dismissed.
