Respective parties are present. Both the parties have filed a joint petition stating there in that they have agreed to settle the matter amicably between themselves as per the terms and conditions stated there in. Both the petitioners have filed. Separate affidavits. The petitioner No.2 has stated in his affidavit that he has no objection if the amount is paid to the account of O.p No.1. who happens to be his wife. The petitioners have filed copy of the legal heir Certificate issued by Tahasildar , Kandhamal.

                From the documents filed by the petitioner it is clear that they are the sole legal heirs of late Niroj kumar Swain and they are competent to receive the claim amount from the O.p.

                 As both the parties have signed the settlement and are in clined for mutual settlement of their dispute,the petition for settlement is allowed and the case is accordingly closed. The terms and conditions of settlement form part of this order.

                The case is accordingly disposed off. Free copy of the order be provided to the parties.
