Heard Mr. M. Smith, learned counsel, appearing for the opposite party No. 4 who has filed Vakalatnama today on behalf of opposite party No. 4. Today, Mr. Smith has filed an application seeking for striking out the name of opposite party No. 4 from the cause title of the complaint petition on the ground that no cause of action accrued nor shown in the complaint petition.

                        As per office note dated 17-08-2022- (i) as per track consignment report bearing No. RS5710576871 N notice on the complaint was duly served on 25-07-2022 under Rupohi Sub Office, (ii) as against track consignment report bearing No. RS571057421N notice to the opposite party No. 3 was shown delivered back to the sub post office to Assam Sachibalaya and delivered to the Registry of this Commission.

                        Since 25-07-2022 i.e. the date on which notice was duly served on the complainant, much time had elapsed and accordingly this complaint is dismissed for default.
