(1)     None is present for the applicant/appellant.  Adv.Anita Marathe is present for the non-applicant/respondent no.1.

 

(2)     The applicant/appellant was directed to file service affidavit as per the Sec.28-A of the Consumer Protection Act, 1986.  However, he has not complied with the order in spite of opportunity given.  On last date i.e. 09/04/2013, the appellant was absent.  Today also he is absent.  It is seen that the applicant/appellant is not willing to proceed with the matter.  Hence, Misc.Application No.MA/12/131 as well as Appeal No.A/12/245 stands dismissed for not taking steps as directed against all non-applicants/respondents.
