This appeal is filed against the order dated 26.6.2017 passed by the District Forum, Jaipur 4^th whereby the claim is dismissed on ground of limitation.

 

The contention of the appellant is that vide letter dated 26.9.2012 his request was not accepted hence, the complaint is within limitation.

 

Heard the counsel for the appellant and perused the impugned judgment.

 

There is no dispute about the fact that the appellant applied for surrender of the policy which was declined vide letter dated 2.7.2012. Now the contention of the appellant is that he has also received the letter dated 26.9.2012. Be that may be the case the complaint filed on 15.10.2012 is still after two years period of limitation and letter dated 26.9.2012 could not give the complainant any rescue and further more when request of the appellant is declined vide letter dated 2.7.2012, communication in relation to it could not give a fresh cause of

action and the Forum below has rightly held that the complaint is time barred.

 

In view of the above, there is no merit in this appeal and stands dismissed.
