Per – Hon’ble Mr. S. R. Khanzode, Presiding Judicial Member

 

          Complainants as well as learned advocate for the Complainants are absent.  Adv. Asim S. Vidyarthi is present on behalf of the Opponent No.1.  Adv. Smt. Anita Marathe is present on behalf of the Opponent No.2.

 

[2]     Last appearance of the Complainants was placed on the record on 18/1/2012.  On that date an adjournment was sought on behalf of the Complainants which was granted subject to payment of costs of `2,000/- payable to the Opponent No.1.  It appears that costs are as yet not paid by the Complainants to the Opponent No.1.  Thereafter on all subsequent dates viz. 3/5/2012, 30/8/2012, 27/11/2012, 6/2/2013, 23/4/2013 and even as on today, Complainants and their counsel remain absent.  Under the circumstances, upon taking into consideration the provisions inter-alia including Rule-8(7) of the Maharashtra Consumer Protection Rules, 2000, the complaint stands dismissed for default.  In the given circumstances, no order as to costs.
