Heard Ld. Advocate for the complainant.

It appears from the record that the complainant stated that the vehicle in question made an accident within the pendeny of the Insurance Policy but after careful scrutiny of the entire materials on record we do not find even a single paper towards establishment of the date of accident and any paper to substantiate the amount of the money claimed in this regard.

It is surprising to note that the complainant perhaps did not lodge any complaint to the Police Authority within the jurisdiction of the place of the accident.

Beside the repudiation letter by o.p. vide annexure – E annexed with the petition of complaint has go no bearing with the instant case since the time of accident was very much covered within the policy period.

Upon considering and on findings above we are of the view that it is not judicious to admit the case since the Ld. Advocate for the complainant fails to make out the prima-facie case and thus instant complaint case is rejected.
