Rajinder vs. Tata AIG General Insurance Co. ltd.

 

Present:     None for complainant.

                               

                This complaint has been called several time since morning, but complainant has not appeared before this Forum on 21.8.2019 up to 2:00PM, neither he has appeared before this Forum either in person or through any Advocate up to 2:45PM, despite having called the case several time since morning.  Further wait is unjustified.  The complaint is liable to be dismissed on account of default of appearance.  Moreover, opponent TATA AIG General Insurance Co. ltd. is corporate body and it has not been sued through of its individual officer, this is also patent defect in the complaint, which is required to be removed. Neither its branch office at Yamuna Nagar, has been impleaded as party. The complaint is dismissed on account of default in appearance.  However, the complainant shall be at liberty to file a fresh complaint, if advised so and while filing the fresh complaint, he will remove the patent defects as observed here-in-before.  File be consigned to the records.
