BY SRI. RAVISHANKAR, JUDICIAL MEMBER.

          Appellant is not present.  None represents on behalf of appellant.  Counsel for Respondent present and submits that as on the date of accident, the insurance policy was not transferred in the name of complainant/appellant and further submits that the order passed by the District Commission has no error and hence, prays to dismiss the appeal.  

On perusal of the order passed by the District Commission it is seen that the District Commission has rightly appreciated that the policy was not transferred in the name of complainant as on the date of accident and it is the bounden duty of the appellant/complainant to get transfer the policy within 14 days as per the terms and conditions of the policy.  Apart from that, the appellant has not submitted his arguments in this regard since long time in spite of providing sufficient opportunities.  It seems the appellant is not interested in continuing the case.  Mere filing of memorandum of appeal is not sufficient to hold the appeal in the absence of any arguments and convincement by the appellant. As such the appeal is liable to be dismissed.  Accordingly, the appeal is dismissed.

Return the LCR forthwith to the concerned District Commission.

          Forward copy of this order to both parties as well as concerned District Commission.
