Present : Vijender, cleark for the counsel for complainant

              : Varun Garg, proxy counsel for OP

 

            Perusal of the record shows that counsel for complainant lastly appeared on 13.09.2017 thereafter either nobody appeared or it is a clerk of the counsel for complainant who keeps on appearing.  Despite various opportunity, counsel for complainant not appeared. We find from the record that policy in question pertains to New Delhi Office which does not come under the territorial jurisdiction of this Commission. Hence the complaint is not maintainable before this Commission in view of lack of territorial jurisdiction.. Complainant is at liberty to file the same before appropriate Court/ Commission after collecting original file from record and placing the certified copy of the same on record.. Limitation, if any be condoned of in the interest of justice for proper adjudication of this matter. Matter is disposed off accordingly. File be consigned to record room.
